7일 법조계에 따르면 서울중앙지법 민사합의48부(김도균 부장판사)는 최근 함평11사단 사건의 피해자 유가족들이 국가를 상대로 낸 손해배상 소송에서 국가가 배상해야 한다고 판결했다.

피해자 1인당 150만 원에서 7800만 원을 배상하는 내용으로 27명의 원고에 대한 손해배상 총액은 4억 3600여만 원이다.

재판부는 "국가권력에 의해 집단적·조직적으로 자행된 사건"이라며 "희생자들은 국가에 의해 위법하게 살해당했다"고 밝혔다.

함평 11사단 사건은 한국전쟁 당시인 1950년 11월부터 이듬해 1월까지,슬롯 무료 칩 탄파 데포국군이 전남 함평군과 장성군 등에서 빨치산에 협력했다는 이유로 주민 258명을 총살하거나 다치게 한 사건이다.

지난 2007년 진실·화해를 위한 과거사 정리위원회(진화위)는 이 사건에 대해 진실규명 결정했다.긴급한 전투 상황이 아님에도 주민들이 빨치산에 협력하고 있다고 판단해 적법절차도 거치지 않고 민간인을 집단 총살한 것은 범죄라며 희생자들에 대한 명예회복과 재발 방지 조치를 취할 것을 권고하는 내용이었다.
