아사히글라스 하청업체에서 근무하다 해고된 노동자들이 아사히글라스 노동자로 인정해달라며 낸 소송에서 최종 승소했다.해고 노동자들이 투쟁에 나선 지 9년 만에 불법파견이 인정됐다.

대법원 3부(주심 엄상필 대법관)는 11일 일본 다국적기업 아사히글라스 해고 노동자 23명이 회사를 상대로 제기한 근로자 지위 확인 소송에서 원고 승소인 원심 판결을 확정했다.원고들이 아사히글라스로부터 실질적인 지휘·명령을 받는 파견관계에 있었기 때문에 아사히글라스를 실질적인 사용자로 봐야 한다는 취지이다.

대법원은 또 파견법 위반으로 기소된 아사히글라스 법인,슬롯 나라 3.0하청업체 대표와 법인에 대해 무죄를 선고한 원심을 다시 심리하라고 사건을 대구지방법원으로 돌려보냈다.해고 노동자들이 실질적인 지휘·명령하는 위치에 있는 아사히글라스가 노조 활동에 지배·개입한 것이 부당하다며 사측을 상대로 낸 부당노동행위 구제 재심판정 취소 소송에서는 원고 패소인 원심 판결을 확정했다.
