"불법 구금 확인"…1차 재심청구 59명 무죄 선고

(서울=연합뉴스) 황윤기 기자 = 검찰이 과거 간첩으로 몰려 억울한 옥살이를 했던 납북귀환 어부들의 명예를 회복하기 위한 2차 직권재심 절차에 착수했다.

대검찰청은 승운호·고흥호·탁성호 등 7척에 탑승했던 납북·귀환 어부 97명에 대해 직권 재심을 청구하라고 이날 춘천지검·강릉지청·순천지청에 지시했다.

재심 청구 대상인 어부들은 1971년 8∼10월 동해에서 어업 중 북한 경비정에 의해 강제 납북됐다가 이듬해 9월 귀환했다.

이들은 집단 수용 상태로 합동신문을 받은 뒤 관할 경찰서로 인계돼 절반 이상이 구속 상태로 수사받았다.

이후 반공법·국가보안법 위반 등 혐의로 재판에 넘겨져 선장·기관장은 대체로 실형을,2024 프로야구 신인드래프트 삼성선원들은 징역형 집행유예를 선고받았다.

이번 명예 회복 조치는 당시 귀환한 어부 160명 중 이미 재심이 청구된 이들을 제외한 전원을 대상으로 한다.97명에 더해 기소유예 처분을 받았던 6명에 대해서는 불기소로 처분을 변경하도록 대검은 지시했다.

대검은 "사건부와 판결문 등을 검토한 결과 구속영장 집행 전까지 법률 근거나 영장 없이 불법 구금된 것을 확인했다"고 밝혔다.

법원은 검찰의 청구를 검토해 적법한 사유가 있다고 인정되면 재심 개시를 결정하고 수사·기소 과정에서의 불법 구금 등이 확인되면 무죄를 선고할 수 있다.

앞서 대검은 1969년 5월 귀환한 납북·귀환 어부 100명에 대해서도 작년 5월 직권 재심 청구를 지시했다.검찰은 유족 동의를 받아 78명에 대해 재심을 청구했고 59명은 무죄를 선고받았다.19명은 계속 재판 중이다.

이원석 검찰총장은 작년 5월 대검 차장(총장 직무대리)으로 부임한 이후 과거 사법 절차에서 피해를 본 이들의 명예 회복에 애쓰고 있다.

2022년 5월에는 5·18 민주화운동 관련자들에 대해,2024 프로야구 신인드래프트 삼성같은 해 8월에는 제주 4·3 사건 관련자들에 대해 직권 재심 청구를 지시했다.
