문체부,해충퇴치기정정보도 청구소송…법원 "허위 사실 인정,해충퇴치기정정보도 해야"

(서울=연합뉴스) 이은정 기자 = 지난해 8월 후쿠시마 오염수 관련 정부 광고의 조회수 의혹을 제기한 MBC 보도가 허위 사실이라며 정정보도를 해야 한다는 법원의 판단이 나왔다.

16일 문체부에 따르면 서울서부지방법원 제12민사부(김진영 부장판사)는 지난 12일 문체부가 '뉴스데스크'의 '후쿠시마 오염수의 진실…두달 만에 1600만 이례적' 보도와 관련해 MBC를 상대로 제기한 정정보도 청구 소송에서 "이 사건 보도는 허위 사실로 인정된다"며 "MBC는 언론중재법에 따라 정정보도를 할 의무가 있다"고 판결했다.

지난해 7월 공개된 '후쿠시마 오염수의 진실'은 정부의 수산물 안전 정책 광고를 위해 제작한 4분 26초짜리 영상으로 당시 조회 수 1천600만 회를 기록했다.

문체부에 따르면 MBC는 이 영상의 조회 수 대다수가 초반 5~6초만 시청한 것이라고 단정해 보도했다.그러나 해당 영상의 유튜브 광고 기준과 분석 시스템에 의하면 당시 조회 수 1천600만 회는 최소 30초 이상 시청한 경우만 집계한 것이고,해충퇴치기평균 시청 시간은 3분 3초였던 것으로 확인됐다.

재판부는 "MBC는 이 판결 확정 후 3일 이내에 '뉴스데스크' 진행자로 하여금 별지에 기재된 정정보도문을 통상적인 진행 속도로 낭독하도록 해야 한다"고 판시했다.

또한 정정보도를 하지 않으면 이행 기간 만료일 다음 날부터 이행 완료일까지 하루에 100만원의 비율로 계산한 간접강제금을 지급하도록 했다

앞서 문체부는 지난해 '뉴스데스크' 보도 직후 정정보도를 요청했으나,해충퇴치기MBC는 뉴스 홈페이지와 유튜브 뉴스 채널 등에서는 보도 내용이 사실과 다르다고 인정하는 보도를 하고 '뉴스데스크'에서는 정정보도를 하지 않았다.

이에 문체부는 언론중재위원회에 정정보도를 신청했으나 MBC가 거부해 지난해 10월 정정보도 청구 소송을 제기했다.
