(서울=연합뉴스) 한주홍 기자 = 하청업체로부터 성과장려금과 판촉비,정보제공료 등 명목으로 350억원대 부당이득을 챙긴 혐의로 기소된 GS리테일이 1심에서 무죄를 선고받았다.

서울중앙지법 형사5단독 박병곤 판사는 13일 하도급거래 공정화에 관한 법률 위반 혐의로 기소된 GS리테일 법인과 김모 전 GS리테일 MD부문장(전무)에게 무죄를 선고했다.

재판부는 "업체들이 자발적으로 판촉비를 지급했다고 보기는 어렵지만,GS리테일에 판촉비를 지급한 구체적 경위가 드러나 있지 않은 이상 GS리테일이 판촉비를 지급하라고 강요·강제했다고 보기 어렵다"고 판단했다.

아울러 "업체들이 제공한 판촉비는 삼각김밥과 편의점 도시락 판매 촉진에 사용됐고,라운지 카지노GS리테일은 업체들이 부담한 비용 이상의 비용을 부담한 것으로 보인다"며 "판촉비 지급이 GS리테일에만 이익이 되고,라운지 카지노업체에만 손해가 됐다고 단정하기 어렵다"고 덧붙였다.

GS리테일은 2016년 11월부터 2022년 4월까지 도시락,라운지 카지노김밥 등을 제조하는 신선식품 생산업체 9곳으로부터 성과장려금 87억여원,판촉비 201억여원,라운지 카지노정보제공료 66억여원 등 총 355억6천만원을 받아낸 혐의로 기소됐다.
