(서울=연합뉴스) 한주홍 기자 = 공정거래위원회가 '통행세'를 이유로 부과한 LS 계열사들의 과징금을 대폭 감면해주는 게 맞는다는 대법원 판단이 나왔다.

14일 법조계에 따르면 대법원 2부(주심 이동원 대법관)는 공정위가 LS그룹 4개 계열사에 부과한 과징금 259억6천100만원 중 189억2천200만원을 취소한 2심 판결을 확정했다.

앞서 공정위는 LS니꼬동제련·LS·LS글로벌·LS전선 등 LS 계열사들이 10년 넘게 총수 일가가 지분의 절반 이상을 보유한 LS글로벌에 이른바 '통행세'를 몰아줬다는 이유로 259억6천100만원의 과징금을 부과한 바 있다.

통행세란 거래 과정에 실질적 역할이 없는데도 총수 일가 소유 회사를 넣어 이 회사에 중간 수수료를 주는 방식으로 부당 이득을 제공하는 것을 의미한다.

대법원은 "국산 전기동 거래와 수입 전기동 거래 모두 부당 지원 행위에 해당한다"면서도 "국산 전기동 거래와 관련해 정상가격 산정이 제대로 되지 않아 그 부분 과징금 납부 명령이 과도하게 산출돼 위법하다"고 판단했다.

불공정 거래 없이 정상적으로 거래했을 때의 가격인 '정상가격'을 기준으로 과징금을 정해야 하는데,대구 카지노 후기공정위가 이를 잘못 산정했다는 의미다.

재판부는 공정위가 LS니꼬동제련에 부과한 과징금(103억6천400만원)은 전액 취소했다.

LS에 대해선 과징금 111억4천800만원 중 78억2천200만원을,대구 카지노 후기LS글로벌에 대해선 14억1천600만원 중 7억3천600만원의 과징금을 취소했다

LS전선의 과징금(30억3천만원)은 전액 인정됐다.
