제자를 성폭행한 혐의 등으로 1심에서 실형이 선고됐던 전직 교수가 항소심에서 더 높은 형을 받았습니다.

법원은 평소 제자들이 아버지처럼 따른 점을 이용해 범죄를 저질러 죄질이 나쁘다고 지적했습니다.

박찬 기자가 보도합니다.

학생들을 성폭행하거나 성추행한 혐의를 받은 전직 교수에게 2심 재판부가 1심보다 높은 형을 선고했습니다.

서울고법 형사 10부는 전 성신여대 사학과 교수 A 씨에게 징역 3년을 선고한 원심을 깨고 징역 4년을 선고했습니다.

재판부는 A씨가 제자인 피해자들이 평소 자신을 아버지처럼 존경하고 따르는 친분 관계 등을 이용해 범죄를 저질러 죄질이 나쁘고 비난 가능성이 크다고 지적했습니다.

또 A씨가 피해자 진술이 번복됐다며 무죄를 주장했던 강제추행 혐의도 1심과 같이 유죄로 판단했습니다.

재판부는 피해자 진술이 구체적인 점 등을 들며 일부 번복은 시간 경과에 따른 부수적인 상황이라고 밝혔습니다.

1심에서 다른 학과 소속 피해자에 대해 '보호 감독 관계'가 인정되지 않는다며 무죄가 선고됐던 피감독자간음 혐의에 대해선 판단이 뒤집혔습니다.

항소심 재판부는 피해자에게 A 씨는 아버지와 같은 사람으로 인식되는 등 보호 감독을 받았다는 법률상 평가가 인정된다고 밝혔습니다.

다만 1심에서 유죄가 선고된 준유사강간 혐의는 무죄로 뒤집혔습니다.

원치 않은 성적 접촉은 인정돼 도덕적 비난을 받기 충분하지만,토토 폴더 뜻준유사강간이 성립되기 위한 조건인 항거불능 상태였는지에 대해선 인정이 어렵다는 판단에 따랐습니다.

A 씨는 선고에 불복해 상고했습니다.

앞서 A 씨는 2017년 학회 소속 학생들과 함께 술을 마신 뒤 개인 서재에 데려가 추행하는 등 학생들을 성폭행,토토 폴더 뜻성추행한 혐의로 기소돼 지난해 10월 1심에서 실형을 선고받고 법정구속됐습니다.
