인천공항공사 소유지 골프장의 전기와 수도 공급을 끊었다가 업무방해 혐의로 재판에 넘겨진 김경욱 전 공사 사장이 1심에서 무죄를 선고받았습니다.

오늘(14일) 인천지방법원은 업무방해 혐의로 불구속기소 된 김 전 사장 등 전·현직 임직원 3명에게 무죄를 선고했습니다.

앞서 인천공항공사는 실시협약이 종료됐는데도 인천공항 토지 364만㎡(110만평)를 무단 점유하고 운영한 스카이72 골프장의 전기와 수도를 끊었습니다.

재판부는 "스카이72는 토지 사용 계약이 끝나고도 3개월 동안 인천공항 시설물인 골프장 부지를 무단으로 점유했다"며 "당시 법적 분쟁이 원만하게 해결될 상황이 아니었고,원주 안스게장인천공항공사의 손해도 매일 발생하고 있었다"고 판단했습니다.

이어 "김 사장 등이 한 단전·단수 조치는 사회 통념상 위법성이 없는 정당한 행위였다"고 설명했습니다.

앞서 검찰은 인천공항공사가 스카이72와 부동산 인도 등 소송을 진행하던 상황에서 일방적으로 전기 등을 끊은 행위는 업무방해에 해당한다고 판단했고 5월 김 전 사장에게 징역 4개월의 실형을,원주 안스게장나머지 임직원 2명에게는 각각 벌금 1000만원을 구형했습니다.
