(울산=연합뉴스) 김근주 기자 = 자녀 중 한 명이라도 반대하면 부모 묘지를 이장할 수 없다는 법원 결정이 나왔다.

울산지법 민사22부(심현욱 부장판사)는 A씨가 다른 형제들을 상대로 제기한 '이장 금지 가처분' 신청을 받아들였다고 3일 밝혔다.

A씨는 올해 5월 형과 누나,대한복권센타울주군 소재 공원묘원 측으로부터 해당 공원묘원에 있는 A씨 부모 분묘 2기를 이장한 후 화장할 예정이라는 통보를 받았다.

그러나 A씨는 '부모의 유지는 화장을 원하지 않고 매장을 원한다'는 것이라며 분묘 이장을 중단시키고자 가처분을 신청했다.

재판부는 망인의 공동상속인으로서 자녀들이 서로 협의해 분묘 관리 여부를 결정하는 것이 원칙이라고 판단했다.

특히,대한복권센타일단 분묘를 이장 후 화장하면 원상복구가 불가능하기 때문에 가처분을 통해 이장 행위를 일단 막을 필요성이 크다고 봤다.

재판부는 "이 사건의 경우 예고된 분묘 개장일까지 시간이 촉박해,대한복권센타심문 절차 없이 가처분할 필요성도 인정됐다"고 밝혔다.
