육군 제12보병사단에서 군기훈련(얼차려)을 받던 중 사망한 훈련병 사건을 수사 중인 경찰이 18일 군기훈련을 지시한 신병교육대 중대장과 부중대장에 대한 구속영장을 신청했다.사건이 발생한 지 24일 만이다.

강원경찰청 형사기동대는 이날 강모 중대장(대위)과 남모 부중대장(중위)에 대해 직권남용가혹행위와 업무상 과실치사 혐의로 검찰에 구속영장을 신청했다고 밝혔다.

경찰은 이들 간부가 지난달 23일 사단 신교대 연병장에서 사망한 A씨를 비롯해 훈련병 6명에게 완전군장 상태로 구보와 팔 굽혀 펴기 등 규정에 맞지 않은 군기훈련을 줘 학대 또는 가혹행위를 했다고 보고 있다.

다만,토토 더존고의성은 없다고 판단해 살인 혐의 대신 업무상 과실치사 혐의를 적용했다.춘천지검은 경찰이 신청한 구속영장을 검토한 뒤 법원에 청구할지 곧 결정할 방침이다.

앞서 지난달 23일 강원도 인제에 있는 12사단 신병교육대에서 오후 5시 20분쯤 군기 훈련을 받던 훈련병 1명이 쓰러져 숨지는 사고가 발생했다.

군기 훈련을 지시한 중대장은 사망한 훈련병에게 완전군장 상태로 구보(달리기)와 선착순 달리기를 시킨 것으로 전해졌다.육군 군기훈련 규정에는 완전군장 상태에선 걷기만 시킬 수 있게 돼 있다.

A 훈련병의 사망 당시 병원 기록에 적힌 직접 사인은 '패혈성 쇼크',토토 더존사망진단서에 기재된 직접사인은 '다발성 장기부전'이다.직접사인의 원인은 '열사병'으로 기록됐다.
