"영장 범위 벗어난 전자정보 수집·복제·활용은 범죄행위"

조국혁신당 조국 대표가 17일 오전 서울 국회 의원회관에서 열린 전자정보 압수·수색에 관한 특례법 제정을 위한 입법 토론회에서 발언하고 있다.[연합뉴스] 조국혁신당 조국 대표는 28일 수사기관의 휴대전화·컴퓨터 등 전자정보 압수수색을 제한하는 내용의 특례법을 발의했다.

조 대표가 의원 신분으로 처음 발의한 법안으로,야구 해설위원 자살전자정보의 '수색·검증'과 '압수'를 분리한다는 원칙이 담겼다.수색·검증만으로 수사의 목적을 달성할 수 있다면 압수는 하지 않도록 했다.

저장매체 정보를 압수 또는 수색할 때는 그 매체가 있는 장소에서 혐의사실과 관련된 정보만 출력 또는 복사하는 '선별 압수' 방식으로 해야 하며,불가피한 때만 원본을 반출한다는 규정도 담았다.

수사기관이 법원에 전자정보 압수수색 영장을 청구·신청할 때는 정보가 필요한 사유,영장 집행에 사용할 검색어와 검색 대상 기간,야구 해설위원 자살예상 분석 기간 등을 구체적으로 적은 계획서를 제출하도록 했다.

범죄 혐의사실과 관련 없는 정보를 얻었다면 48시간 이내에 삭제·폐기하거나 돌려줘야 하며,야구 해설위원 자살그렇지 않으면 형사처벌 하는 내용도 포함됐다.

조 대표는 "검찰이 영장 범위를 벗어난 전자정보를 불법적으로 관리,복제,활용하는 것은 보통 사람들이 겪어야 하는 인권침해 문제"라며 "범죄 행위나 다름없는 불법적인 전자정보의 수집과 복제,야구 해설위원 자살별건 수사 활용을 근절하고자 한다"고 말했다.
