숨진 18명 외국인 노동자들은 대부분 한 도급업체 소속입니다.

[조선호/경기도 소방재난본부장 : 용역회사에서 필요할 때 파견을 받아서 쓰는 일용직인 분들이 대부분이고.]

추적해봤습니다.

그런데 이 업체 주소,주술회전 명장면 월드컵불이 난 아리셀 공장과 주소가 같은 곳이었습니다.

이유가 있었습니다.

[인력사무소 직원 : 공장도 솔직히 사람 구하기 힘드니까 편의를 봐주는 거죠.]

영세한 도급업체는 운영비를 줄이고 원청 업체는 노동자 구하기 좋기 때문에 쓰는 편법이란 겁니다.

하지만 명백한 불법입니다.

[인력사무소 직원 : 그거는 그냥 불법이라고 보시면 돼요.그러니까 합법적인 부분에서 좀 벗어난 거죠.]

이럴 경우 불법 체류 노동자를 채용하는 일도 잦아질 수 있다고 설명합니다.

[인력사무소 직원 : 공장을 돌려야 되는 상황이고 테두리에서 조금 벗어난 그런 부분들도 없지 않죠.]

도급 업체는 미등록 노동자를 공급하고 대신 단속이 되면 책임은 도급업체가 지는 구조라는 겁니다.

[인력사무소 직원 : 알면서도 눈감아주는 경우도 있고.대부분 업체가 그렇게까지 깊게 관여를 안 해요.]

대부분 업체를 만들었다 폐업했다를 반복하기 때문에 고용노동부에도 등록돼 있지 않습니다.

실제 아르셀에 인력을 파견한 도급업체도 등록 상태가 아니었습니다.

아르셀은 불법 채용은 없었다고 단언했습니다.

[박순관/아리셀 대표 : {일용직 노동자 많았는데 불법 파견은 없었는지?} 그런 것 없었습니다.]

경찰은 도급 업체가 여러 차례 이름과 사업장을 바꿔온 정황을 파악하고 사실관계를 조사하고 있습니다.
