[서울=뉴시스]송연주 기자 = 보툴리눔 톡신 의약품의 허가 취소를 둘러싼 식품의약품안전처와 메디톡스의 항소심에서 법원이 메디톡스의 손을 들어줬다.

메디톡스는 대전고등법원 제1행정부가 보툴리눔 톡신 제품 '메디톡신' 전단위(50·100·150·200),성호스님 도박'코어톡스'(100단위)에 대한 허가 취소 및 판매정지 처분을 모두 취소한 1심 판결 관련 식약처 항소에 대해 메디톡스 일부 승소를 선고했다고 13일 밝혔다.

1심과 같이 '품목허가 취소 처분' '회수폐기사실 공표 명령'을 취소하는 판결을 선고했다.

다만 판매업무정지 1개월 처분은 적법하다고 봤다.

앞서 식약처는 2020년 주름개선에 쓰이는 메디톡스의 보툴리눔 톡신 제품에 대해 국가출하승인을 받지 않고 제조·판매했다는 이유로 해당 제품 회수와 폐기 등을 명령했다.

국가출하승인이란 보건위생상 특별한 주의가 필요한 생물학적 제제의 안전성과 유효성 확보를 위해 국내에 판매하기 전 식약처장의 제조·품질관리에 관한 자료 검토 및 시험검정 등을 거쳐 제조단위별로 출하승인을 받는 것을 말한다.

이후 메디톡스가 대전지방식품의약품안전청을 상대로 제기한 행정소송에서 작년 11월 대전지법 행정3부는 메디톡스의 청구를 인용했다.

메디톡스 관계자는 "인용된 판매업무정지 1개월 처분에 대해 집행정지를 즉각 신청해 판매에 차질이 없도록 하겠다"며 "대법원 상고를 통해 판매업무정지 1개월 처분의 위법성을 밝힐 수 있도록 최선을 다하겠다"고 말했다.
