유럽연합(EU)이 페이스북 모회사 메타를‘빅테크 갑질’방지를 위한 디지털시장법(DMA) 위반으로 제재하기로 했다고 파이낸셜타임스(FT)가 1일 보도했다.

소식통에 따르면 EU 집행위원회는 메타에 대한 예비조사에서 페이스북과 인스타그램의‘유료 또는 동의(pay or consent)’모델이 DMA를 위반했다고 결론 내린 것으로 알려졌다.유료 또는 동의 모델은 사용자가 서비스 이용료를 내지 않으려면 광고 목적 데이터 수집에 동의해야 한다는 메타의 약관이다.EU는 이 같은 규정이 사용자에게 일방적으로 불리한 내용을 담고 있다고 판단한 것으로 전해졌다.

EU는 메타 측에 통보한 뒤 해명·반론 청취 과정 등을 거쳐 제재 수위를 최종 결정할 예정이다.DMA를 위반하면 전 세계 연간 매출의 최대 10%에 해당하는 과징금이 부과될 수 있다.반복적 위반이라고 판단되면 과징금을 최대 20%까지 상향할 수 있다.

메타는 성명을 통해 “유료 또는 동의 약관은 EU 최고재판소 판례와 DMA 조항에 부합한다”며 “EU 집행위원회와 건설적 대화를 나누길 기대한다”고 밝혔다.

EU가 메타를 제재하면 앞서 애플 앱스토어의 운영 방식이 DMA 위반에 해당한다고 잠정적으로 결론 내린 데 이어 두 번째 사례가 된다.DMA는 거대 플랫폼 사업자의 시장지배력 남용을 방지하고자 일정한 규모의 플랫폼 사업자를‘게이트 키퍼’로 지정해 특별 규제하는 법률이다.
