심리불속행 기각으로 확정…"동일한 법리 유사소송 취하하라"

(서울=연합뉴스) 김정진 기자 = 참여연대는 서울 용산 대통령실 앞 집회를 금지한 경찰 처분을 취소하라며 제기한 소송에서 최종 승소헸다고 28일 밝혔다.

참여연대에 따르면 대법원은 참여연대가 대통령실 인근 기자회견·집회를 금지한 경찰의 처분을 취소하라며 낸 소송에 대해 심리불속행 기각으로 원고 승소한 원심 판결을 확정했다.

심리불속행 기각은 2심 판결에 중대한 법령 위반 등 법이 정한 특별한 사유가 없으면 대법원이 본안 심리 없이 바로 기각하는 제도다.

참여연대는 한미 정상회담을 앞둔 지난 2022년 5월 21일 용산구 국방부와 전쟁기념관 앞에서 기자회견과 집회를 열겠다며 경찰에 신고했으나 금지통고를 받았다.

당시 경찰은 집시법 제11조 제3호를 근거로 집회 신고를 받아들이지 않았는데 이에 참여연대는 대통령 관저와 집무실은 별개라고 주장하며 집행정지를 신청하고 취소 소송을 제기했다.

집시법은 대통령 관저로부터 100ｍ 이내 장소의 집회를 금지하고 있다.

참여연대는 경찰에 동일한 법리를 다투는 유사 소송의 상고심을 즉각 취하하라고 촉구했다.
