머리 '툭툭' 주장에 법원 "폭행 명백" 벌금 500만원…검찰은 항소

'김건희 여사 명품백'과 관련한 대화 중 택시 운전기사의 얼굴 등을 때려 폭행한 60대 승객이 벌금형을 선고받았다.

법조계에 따르면 춘천지법 원주지원 형사3단독 황해철 판사는 특정범죄 가중처벌 등에 관한 법률 위반(운전자 폭행 등) 혐의로 불구속기소 된 A(65)씨에게 벌금 500만원을 선고했다고 29일 밝혔다.

지난 1월 23일 오후 10시 45분께 원주에서 B(66)씨가 운행하는 택시에 탑승한 A씨는 정치 관련 대화를 나누다가 '여사가 명품 가방을 받은 것이 잘못된 것 같다'는 B씨의 말에 화가 나 주먹으로 B씨의 얼굴을 여러 차례 때린 혐의로 기소됐다.

운행 중인 택시 운전자를 폭행한 혐의로 재판에 넘겨진 A씨는 '정신을 차리라'는 취지로 B씨의 머리를 몇 대 툭툭 친 것일 뿐 폭행이 아니라고 주장했다.

이에 황 판사는 "피고인이 주먹으로 운행 중인 택시 기사 B씨의 얼굴,프로야구 프런트머리 등을 여러 번 때려 폭행한 사실이 명백히 인정된다"고 판시했다.

그러면서 "이해하기 어려운 주장으로 범행을 부인하고 반성하는 모습도 보이지 않는 것은 물론 용서받기 위한 노력도 하지 않는 점 등을 고려해 형을 정했다"고 덧붙였다.

1심 벌금형 판결에 불복한 검찰은 양형 부당 등을 이유로 항소했다.
