(대구=뉴스1) 이성덕 기자 = 대구지법 제11민사부(부장판사 성경희)는 2일 A 씨(66)가 전처 B 씨(64)를 상대로 제기한 '국민연금 분할 취소' 소송에서 원고의 청구를 기각했다고 밝혔다.

A 씨와 B 씨는 2020년 9월 '협의이혼에 따른 약정서'를 체결하고 이혼했다.약정서에는 토지와 대출금 채무에 대한 내용만 명시돼 있을 뿐 연금 수급권에 관한 내용은 없었다.A 씨는 "협의이혼 과정에서 B 씨가 분할연금 수급권을 포기하겠다는 구두 약정을 해놓고 분할연금을 청구해 38만원을 수령했다"며 소송을 냈다.

국민연금법에 따르면 혼인기간이 5년 이상이면 배우자가 노령연금을 분할해 일정 금액을 받을 수 있다.

재판부는 "원칙적으로 일정한 수급 요건을 갖춘 이혼배우자는 국민연금법에 따라 혼인 기간에 해당하는 금액을 균등하게 나눠 받을 수 있다"며 "원고가 제출한 증거만으로 피고가 분할연금 수급권을 포기하기로 약정했다고 인정하기 어렵다"고 판시했다.
