서울북부지방법원.[연합뉴스]좌회전 중 인도로 돌진해 사망사고를 내고 급발진을 주장한 60대 남성에게 금고형의 집행유예가 선고됐다.

16일 법조계에 따르면 서울북부지법(형사10단독 김일수 판사)는 교통사고처리법 위반(치사) 혐의로 기소된 A(64)씨에게 금고 1년에 집행유예 2년을 선고했다.

A씨는 지난해 6월 12일 오후 1시18분께 서울 성북구의 한 교차로에서 좌회전하다가 인도로 돌진해 길을 걷던 60대 여성을 들이받았다.피해자는 인근 병원으로 이송됐지만 사고 당일을 넘기지 못하고 결국 숨졌다.

A씨 측은 재판 과정에서 차량의 급발진으로 일어난 사고라며 과실이 없다는 취지로 주장했다.

그러나 재판부는 국립과학수사연구원의 진단검사 결과에서 A씨가 운전한 차량에 급격한 출력 증가와 제동 불능을 유발할만한 특이한 흔적은 없었다는 점을 고려해 A씨 측 주장을 받아들이지 않았다.

또한 차량의 사고기록장치(EDR) 기록정보에도 사고 당시 브레이크 페달이 작동했다는 기록이 없었으며 오히려 가속 페달을 밟은 것으로 드러났다.

재판부는 “피해자의 유족이 피고인의 처벌을 원하고 있는 점 등에 비추어 보면 피고인을 엄히 처벌할 필요가 있다”고 밝혔다.

다만 A씨가 형사처벌을 받은 전력이 없고 피해자 유족에게 3천만원을 지급한 점 등은 유리한 정상으로 고려됐다.
