(서울=연합뉴스) 채새롬 기자 = 1천억원 규모의 불법 공매도 혐의가 적발된 글로벌 투자은행(IB)에 역대 최다 규모인 271억원의 과징금이 부과됐다.

금융위원회 증권선물위원회는 3일 제13차 회의에서 공매도 규제를 위반한 구 크레디트스위스 그룹 소속 2개 계열사인 CSAG(현 UBS AG),무료 포커 게임CSSL에 대해 과징금 총 271억7천300만원을 부과하는 조치를 의결했다.

이는 2021년 4월 무차입 공매도에 대한 과징금 제도가 시행된 이후 부과된 과징금 중 역대 최다 수준이다.

이전까지 개별 글로벌 IB에 부과된 과징금 역대 최다 액수는 169억4천만원이었다.

증선위에 따르면 CSAG는 2021년 4월 7일부터 2022년 6월 9일까지 소유하지 않은 20개사 주식 16만2천365주(주문 금액 약 603억원)에 대해 매도 주문을 제출했다.

CSSL은 2021년 11월 29일부터 2022년 6월 9일까지 소유하지 않은 5개사 주식 40만1천195주(주문 금액 약 353억원)에 대해 매도 주문을 제출했다.

이들은 같은 금융그룹 소속 계열사나 다른 증권사에 대여 중이던 주식의 반환이 확정되기 전에 이를 매도해 공매도 규제를 위반했다.

또한 대여 중인 주식을 제3자에게 매도(T일)하면서 차입자에게 주식 중도상환 요청을 그 다음날(T+1) 실시했다.

증선위는 매도주문 시점에서 해당 주식매매 결제일(T+2)까지 대여 중인 주식의 반환이 확정되지 않아 결제 불이행으로 이어질 소지가 있었기 때문에 무차입 공매도에 해당한다고 봤다.

다만 실제 결제 불이행으로 이어지지는 않았고,무료 포커 게임시장에 영향이 없었다는 점 등을 고려해 금융감독원이 당초 사전 통지한 것으로 알려진 500억원보다는 과징금이 줄어들었다.

증선위는 이에 앞서 6월 19일 제12차 회의에서는 공매도 순보유잔고 보고 및 공시 의무를 위반한 국내외 금융투자업자 6개사와 개인투자자 1인에 대하여 과태료 총 2억 8천420만원을 부과하는 조치를 의결했다.
