여중생과 성관계를 가진 혐의로 기소된 명문대생이 징역 4년의 실형을 선고받았다.이 대학생은 판결이 선고되자 자신의 혐의를 부인하며 쓰러지기도 했다.

24일 법조계에 따르면 대전지법 천안지원 제1형사부(재판장 전경호)는 이날 미성년자의제강간 등의 혐의로 구속기소 된 A씨(26)에 대해 징역 4년을 선고했다.

더불어 아동·청소년 및 장애인 관련 기관 취업 제한 각 7년과 위치추적 전자장치 부착 6년,토트넘 홋스퍼 인스타5년간 정보통신망 이용 정보공개도 명령했다.

앞서 A씨는 지난해 10월 사회관계망서비스(SNS)를 통해 알게 된 B양(당시 13세)과 아파트 옥상에서 성관계를 맺고 엘리베이터에서 강제 추행한 혐의를 받는다.

A씨는 미성년자와 성관계했다는 사실로 처벌받을 것을 대비해 B양에게 자신이 미리 준비한 원고를 읽게 하고 이를 녹음한 혐의도 받는다.

A씨는 B양이 미성년자인 줄 몰랐고 성관계나 추행한 사실도 없다고 주장했지만 법원은 A씨의 주장을 받아들이지 않았다.

재판부는 "범행 전후 피해자의 구체적인 진술이 아파트 CCTV에 녹화된 영상 내용과 일치한다"며 "피해자로 하여금 나이를 속인 것처럼 연기하게 하는 등 교활함을 보였다"고 지적했다.

그러면서 "잘못을 추궁하는 피해자 부모에게 오히려 형사처벌 가능성을 언급하며 뻔뻔함과 가증스러움을 보였다"며 "죄책에 상응하는 보다 엄중한 처벌을 부과할 필요가 있다"고 양형 이유를 밝혔다.

판결이 선고되자 A씨는 "진짜 아닙니다"를 반복해 말하다 쓰러지기도 했다.
