19일 법조계에 따르면 광주지법 형사10단독 나상아 판사는 사기와 고용보험법 위반 혐의로 기소된 식자재 도소매업자 A(53)씨에 대해 징역 10개월에 집행유예 2년을 선고하고 사회봉사 200시간을 명령했다.

함께 기소된 A씨의 업체 전·현직 직원 8명에 대해서는 50만∼200만원의 벌금형을 선고했다.

A씨는 2021∼2022년 정상적으로 근무 중인 직원들이 사직한 것처럼 거짓으로 꾸며,마이애미 보스턴직원들과 함께 1억4000여만원의 실업급여를 받도록 한 혐의로 기소됐다.

회사의 실제 경영자인 A씨는 매출이 급감해 운영이 어려워지자 근무 중인 직원들이 권고 사직했다고 서류를 꾸며 받은 실업급여로 임금 등을 지급했다.

직원들은 회사에 근무하면서도 밀린 임금을 받기 위해 A씨의 지시대로 범행에 가담해 실업급여를 허위 신청한 것으로 알려졌다.

나상아 판사는 “실업급여를 부정 수급한 해악은 가볍지 않으나,마이애미 보스턴피고인들이 부정수급액을 변제한 사정 등을 고려해 집행유예나 벌금형을 선고한다”고 판시했다.
