분양가 상한제 주택의 실거주 의무를 3년 유예하는 주택법이 시행되면서 부부 공동명의와 관련된 혼선이 일자,박민석 야구국토교통부가 부부 공동명의 변경이 가능하다는 유권해석을 내리기로 했습니다.

국토부는 잔금 대출 등에 차질이 생길 것을 우려한 분양가 상한제 아파트 계약자들의 민원과 유권해석 요구가 쇄도한 데 따라 이를 검토하고 있다고 밝혔습니다.

지난 3월 실거주 의무는 유예됐지만,박민석 야구양도나 매매·증여를 포함한 권리변동을 할 수 없게 되자,박민석 야구공동명의로의 변경을 통해 대출 한도를 늘리려했던 일부 청약 당첨자들이 잔금을 치루는데 문제가 생겼던 겁니다.

앞서 한국토지주택공사는 인천영종 공공주택 분양자들에게 부부 공동명의 변경 신청을 받겠다고 안내했다가 이후 안내문을 정정해 '부부 공동명의 변경 승인행위가 위법하다는 의견을 받아 불가하다'고 공지하기도 했습니다.

혼선이 커지자 국토부가 법률 검토를 통해 부부 공동명의 변경을 허용하기로 한 겁니다.

국토부 관계자는 "국민들 입장에서는 법문이 바뀌었을 뿐이지 상황이 바뀐 것은 없다"며 "이 경우 법을 적극적으로 해석하는 것이 맞다고 판단했다"고 말했습니다.
