공탁계 근무하면서 전산 조작해 범행.재판부 "신뢰도 심각하게 훼손"

법원 전산을 조작해 공탁금 수십억 원을 빼돌린 전 부산지법 공무원에게 중형이 선고됐다.

부산지법 형사5부(장기석 부장판사)는 10일 특정경제범죄 가중처벌 등에 관한 법률 위반(횡령) 등 혐의로 기소된 전 부산지법 공무원 A(40대)씨에 징역 13년을 선고했다.

A씨는 부산지법 종합민원실 공탁계에 근무하면서 지난 2022년부터 53회에 걸쳐 공탁금 48억여원을 빼돌린 혐의로 재판에 넘겨졌다.

횡령한 돈 중 37억여원은 주식투자를 했다가 손실을 봤고 나머지는 신용카드 결제대금,편의점 토토 알바개인 채무에 5억원,편의점 토토 알바가족들에게도 일부 송금한 것으로 확인됐다.

재판부는 "법원 공무원으로서 도덕성과 청렴성을 갖추고 적법하게 공무를 집행해야 함에도 피공탁자가 '불명'인 경우 피공탁자를 임의로 변경해 공탁금을 출금하더라도 발각될 가능성이 희박하다는 점을 악용해 범행을 실행하는 등 그 죄책이 매우 중하다"라고 설명했다.

그러면서 "범행으로 국가에 막대한 손해가 발생했고 공적 업무의 집행 기능과 공무원의 직무 공정성에 대한 사회적 신뢰도 심각하게 훼손되는 결과가 초래됐다"라고 양형 이유를 밝혔다.
