2022년 11월 육군 12사단 GOP(일반전초)에서 집단 괴롭힘 끝에 극단적 선택을 한 고(故) 김상현 이등병 사건과 관련해 법정에 선 가해자들이 혐의를 모두 부인했다.

26일 법조계에 따르면 전날 춘천지법 형사1단독 신동일 판사는 초병협박 혐의로 기소된 A(22)씨와 모욕 혐의로 기소된 B(24)씨,실시간 tv중계강요와 협박 혐의로 기소된 C(22)씨에 대한 첫 공판을 열었다.

김 이병의 선임이었던 A씨는 2022년 11월 초병 근무 중 암호를 확인하는 수하를 실시하지 않았다며 김 이병을 추궁하고 협박한 혐의로 재판에 넘겨졌다.

B씨는 당시 분대장(하사)으로 김 이병의 말투를 따라하며 모욕한 혐의로 기소됐으며 선임병인 C씨는 고인에게 실수 노트 쓰기를 강요하거나 총으로 쏴버리겠다고 협박한 혐의로 재판에 넘겨졌다.

이날 재판에 출석한 피고인들은 객관적인 행위 자체는 인정했으나 '법리적으로 혐의가 적용될 수 없다',실시간 tv중계'범행 사실이 없었다'며 혐의를 전면 부인했다.

재판부는 이들이 혐의를 부인함에 따라 수사기관에서 진술한 인물들을 차례로 불러 증인신문을 진행하기로 했다.

김 이병은 2022년 11월 28일 강원 인제군 육군 12사단 GOP에서 경계근무 중 총상을 입고 숨졌다.

군 당국은 김 이병이 선임병 등으로부터 집단 괴롭힘을 겪다 극단적 선택을 한 것으로 보고 사건을 경찰에 넘겼고 경찰은 가해자로 지목된 피의자들 중 4명을 송치했다.검찰은 이들 중 3명을 재판에 넘겼으며 피고인들은 모두 전역한 상태다.
