석공사 하도급 대금과 지연이자 미지급에 대금지급명령도공정거래위원회는 수안종합건설(주)이 수급사업자에게 건설공사를 위탁하면서 하도급대금 및 지연이자를 지급하지 않은 행위에 대해 대금지급명령과 재발방지명령 등 시정 명령을 결정했다고 8일 밝혔다.

수안종합건설은 '부산진구 부전동 소재 근린생활시설 신축공사’중‘석공사’를 수급사업자에게 위탁하고 목적물을 수령했다.그러나 하도급대금 약 2504만원과 일부 하도급대금의 지연지급에 따른 지연이자 약 484만원을 지급하지 않았다.석공사는 돌을 벽체나 구조물로 쌓거나,월드컵 백화점다른 구조물에 붙여 마감하는 공사다.

목적물 수령일로부터 60일 이내의 가능한 짧은 기한으로 정한 지급일까지 하도급대금을 지급한다.60일을 초과해 지급하면 지연이자를 함께 지급하도록 규정된 '하도급거래 공정화에 관한 법률(하도급법)' 제13조 제1항 및 제8항에 위반된다.

이번 조치는 원사업자가 객관적으로 수급사업자에게 공사 지연의 책임을 부담시킬 수 없는데도 수급사업자에게 지급하지 않던 하도급대금을 지급하도록 한 데 의의가 있다.

공정위는 "앞으로도 원사업자의 불공정하도급거래행위에 대하여 지속적으로 감시하고 법 위반 행위 적발 시 엄중 제재할 계획"이라고 밝혔다.
