30일 법조계에 따르면 서울행정법원 행정5부(김순열 부장판사)는 공무원 A씨가 공무원연금공단을 상대로 제기한 분할연금 일시금 지급처분 취소 청구 소송을 원고 승소로 판결했다.

공무원인 A씨는 B씨와 2019년 이혼했다.이후 B씨는 2022년 공무원연금공단에 A씨의 연금 분할을 청구했다.

공단이 이를 승인했고 A씨는 소송을 제기했다.B씨와의 이혼소송 당시 퇴직급여까지 포함한 A씨 재산 총액보다 채무가 더 많다는 이유로 B씨의 재산분할 청구가 법원에서 기각됐으므로 연금 분할도 청구할 수 없다는 주장이었다.

이에 대해 재판부는 "이혼소송 당시 이미 재산분할 청구가 기각돼 B씨의 분할연금 청구권이 인정되지 않는다"며 A씨의 손을 들어줬다.

재판부는 "이혼소송 당시 퇴직연금 존부와 가액에 대한 평가는 이미 마쳐졌다"며 "B씨는 더 이상 A씨의 퇴직연금 등에 관해 이혼배우자의 권리를 행사할 수 없다는 점이 확정됐다"고 밝혔다.
