(서울=연합뉴스) 황윤기 기자 = 학생이 지각하거나 수업 시간에 졸았다는 이유로 야구방망이로 엉덩이를 때린 고등학교 담임 교사에게 징역형 집행유예가 확정됐다.

4일 법조계에 따르면 대법원 1부(주심 김선수 대법관)는 아동복지법 위반(아동학대) 혐의로 기소된 A씨에게 징역 8개월에 집행유예 1년 6개월을 선고하고 120시간의 사회봉사와 40시간의 재범예방 강의 수강을 명령한 원심판결을 지난달 13일 확정했다.

A씨는 2019년 3∼4월 경기 평택의 고등학교 1학년 담임교사로 일하면서 총 6차례 자신이 가르치던 학생의 엉덩이를 야구방망이로 1회씩 때려 신체적·정서적으로 학대한 혐의로 기소됐다.

같은 해 9월에는 복도에서 피해자를 마주치자 어깨를 펴라며 주먹으로 가슴을 때린 혐의도 있다.피해 학생은 2학기부터 등교를 거부한 것으로 알려졌다.

A씨는 아주 약한 정도로 때렸으므로 학대는 아니라고 항변했으나 받아들여지지 않았다.

1심 법원은 그가 피해자의 안정을 위해 무급휴직과 전근을 했고 법원에 합의금 명목으로 3천만원을 공탁한 점을 반영해 징역형 집행유예를 선고했다.

A씨가 판결에 불복했으나 2심과 대법원의 판단도 같았다.
