서울북부지방법원 [연합뉴스] 과거 음주운전으로 인해 철창 신세를 진 전력이 있음에도 또다시 술에 취한 채 운전대를 잡은 한의사가 징역형을 선고받았다.

12일 법조계에 따르면 서울북부지법 형사2단독 임정엽 부장판사는 도로교통법상 음주운전 혐의로 기소된 박모(48)씨에게 징역 8개월에 집행유예 2년을 선고했다.아울러 40시간의 준법운전강의 수강을 명령했다.

박씨는 지난해 12월 22일 오전 1시 20분쯤 서울 노원구에서 면허 취소 수준(0.08％ 이상)인 혈중알코올농도 0.100％ 상태로 운전한 혐의를 받는다.그는 운전하며 정차 중이던 다른 차량을 들이받기도 했다.

앞서 박씨는 지난 2004년과 2008년,축구경기 실시간2009년에도 음주운전으로 각각 벌금 100만원씩을 선고받았다.이후 2017년 9월 음주운전과 공무집행 방해 등의 혐의로 징역 8개월을 선고받고도 또 범행을 저지른 것이다.

박씨는 그 외에도 교통사고처리 특례법 위반,축구경기 실시간업무방해와 상해,축구경기 실시간폭행 등의 혐의로 여러 차례 벌금형과 징역형을 선고받은 전력이 있는 것으로 전해졌다.

박씨 측은 재판에서 집행유예 이상의 형이 선고될 경우 한의사 자격이 정지될 수 있다며 벌금형을 요청했지만 재판부는 받아들이지 않았다.

재판부는 "피고인이 벌금형을 선고받을 경우 다시 음주운전을 함으로써 다른 사람의 생명과 신체에 위험을 초래할 가능성이 높다고 판단된다"고 판결 이유를 설명했다.

다만 이번 사건으로 인명 피해가 발생하지 않은 점,축구경기 실시간박씨가 어린 자녀와 어머니를 부양하고 있는 점은 유리한 양형 요소로 고려됐다.
