[앵커]

재판의 핵심 쟁점이었던 불법 대북송금 공모 혐의에 대해 재판부는 2백만 달러가 북한 조선노동당에게 전달됐다고 판단했습니다.

특히 이 돈이 이재명 당시 경기도지사의 방북 비용으로 밀반출된 점을 인정했습니다.

판결 내용을 배지현 기자가 분석했습니다.

검찰이 본 불법 송금 규모는 모두 800만 달러입니다.

재판부는 이 가운데 394만 달러가 해외로 밀반출됐다고 인정했습니다.

164만 달러는 경기도의 스마트팜 사업비로,wolow230만 달러는 당시 경기지사였던 이재명 더불어민주당 대표의 방북 비용으로 밀반출 됐다고 봤습니다.

두 건 모두,wolow쌍방울이 해당 비용을 대납할 목적으로 밀반출했다고 인정한 겁니다.

그동안 이 전 부지사측은 쌍방울이 주가를 띄우기 위해 대북사업을 추진하는 과정에서 불법 송금을 했다는 주장을 펴왔지만 재판부는 받아들이지 않았습니다.

재판부는 "이 전 부지사의 요청으로 김성태 전 회장이 대납한 것이 아니라면 쌍방울이 갑작스럽게 대북 사업을 추진한 것은 이해하기 어렵다"고 밝혔습니다.

특히,wolow방북 비용으로 해외 밀반출된 230만 달러 가운데 200만 달러는 실제로 금융제재대상인 북한 조선노동당에 전달됐다고 봤습니다.

재판부는 나머지 금액에 대해서는 조선노동당에 지급됐다고 보기 어렵다는 등의 이유로 무죄로 판단했습니다.

핵심 쟁점이었던 이재명 당시 경기지사의 지시 여부에 대해선 따로 판단을 하지 않았습니다.

재판부는 "경기도지사에게 보고했느냐는 이 사건과 무관하다"며 공소사실이 아니기에 김성태 전 회장의 행동 동기로 평가하는 것이 적절하다"고 밝혔습니다.
