인천지검 공판송무2부(장진성 부장검사)는 최근 폭력행위 등 처벌에 관한 법률상 공동상해 등 혐의로 징역 2년을 선고받은 전직 보디빌더 A(39) 씨의 1심 판결에 불복해 법원에 항소장을 제출했다고 오늘(5일) 밝혔습니다.

검찰은 "피고인은 피해자의 정당한 요구에도 말다툼하다가 중상을 입혔다"며 "피해자에게 침을 뱉는 등 모멸적인 행위도 서슴지 않았다"고 설명했습니다.

이어 "피해자가 여전히 엄벌을 탄원하고 있다"며 "원심이 선고한 형은 가벼워 더 무거운 형이 선고돼야 한다"고 항소 이유를 밝혔습니다.

앞서 검찰은 지난달 1일 열린 결심 공판에서 A 씨에게 징역 3년 6개월을 구형했습니다.

사건 현장에 함께 있던 A 씨 아내도 지난해 공동상해 혐의로 함께 형사 입건됐지만 임신한 상태여서 경찰 조사를 받지 않았습니다.

경찰은 A 씨 아내가 출산한 사실을 최근 확인한 만큼 조만간 소환해 조사할 방침입니다.

전직 보디빌더인 A 씨는 사건 발생 후 운영하던 체육관을 폐업한 것으로 알려졌습니다.
