고속도로서 차 세운 남편은 '금고 2년'

고속도로에서 부부싸움을 하다가 차에서 내린 여성을 차로 치어 숨지게 한 버스 기사와 차를 세운 여성의 남편에게 법원이 금고형을 선고했다.

대전지법 형사9단독은 26일 교통사고 처리 특례법상 치사 혐의로 기소된 버스 기사 A(59)씨에게 금고 1년을,로또 658업무상과실치사 혐의로 기소된 남편 B(66)씨에게 금고 2년을 각각 선고했다고 밝혔다.

금고형은 징역형처럼 교도소에 수감되기는 하지만 강제 노역은 하지 않는다.

버스기사 A씨는 지난해 3월 19일 오전 9시 25분쯤 충북 청주 서원구 남이면 경부고속도로 서울 방면 편도 4차로 중 1차로에서 고속버스를 운전하던 중 멈춰 있던 승용차의 뒤에 서있던 B씨의 아내 C(65)씨를 들이받아 숨지게 한 혐의를 받았다.

아내 C씨는 남편 B씨가 운전하는 승용차를 타고 가던 중 과속 문제로 부부싸움을 했다.남편 B씨는 아내 C씨의 이 같은 말에 화를 내며 "당신이 차 타고 가"라고 하면서 차선을 급변경했고,로또 658버스 전용 차로인 1차로에 차를 세웠다.

정차 후 남편 B씨와 아내 C씨가 각각 조수석과 운전석으로 이동하던 중 아내는 뒤에서 오던 버스에 치였다.

재판부는 "A씨는 전방 주시 의무를 하지 않아 C씨를 사망에 이르게 했고 유족과 합의도 이뤄지지 않았다"며 "B씨는 홧김에 차선을 급변경한 뒤 정차해 아내를 숨지게 한 업무상 과실이 있는 데다 가족과 유족으로부터 용서를 받지 못했다"고 판단했다.

이어 "남편 B씨는 3천만원을 형사공탁했지만 유족이 이를 수령할 의사가 없기 때문에 제한적으로 형량에 참작했다"고 밝혔다.
