1심은 이들 모두에게 징역형 집행유예를 선고했습니다.이와 달리 2심은 정 씨가 "제조 방법을 영업비밀로 인식하고 취득했다고 보기 어렵다"며 무죄를 선고했습니다.

하지만 대법원은 "해당 제조법은 피해 회사가 상당한 비용과 노력을 들여 개발했고 불특정 다수에게 공개된 정보가 아니다"라며 처벌이 가능하다고 봤습니다.
