직권남용 가혹행위,팝콘 월드컵업무상 과실치사 혐의

육군 12사단에서 발생한 '훈련병 사망' 사건과 관련해 규정을 어기고 군기훈련(얼차려)을 지시한 혐의를 받는 중대장과 부중대장이 검찰에 구속송치됐다.

27일 강원경찰청 '훈련병 사망사건 수사전담팀'은 직권남용 가혹행위와 업무상 과실치사 혐의로 중대장과 부중대장을 검찰에 구속 송치했다.

부중대장은 사건 당일 중대장에게 구두보고 후 승인을 받고 군기훈련을 실시한 혐의를 받고 있다.

군기훈련은 관련 법령에 따라 훈련 대상자에게 확인서를 작성하도록 해 군기훈련 실시사유를 명확히 하고 소명기회를 부여한 후 실시 여부를 최종 판단해야 한다.

하지만 당이 이 같은 절차를 제대로 지키지 않고 군기훈련을 실시한 것으로 드러났다.

부중대장은 훈련병들에게 군장의 빈 공간을 책으로 채우게 하는 방법을 지시한 뒤 총기 휴대 후 연병장을 보행하게 했다.

이어 중대장은 완전군장 상태로 연병장을 선착순으로 뜀걸음 시킨 뒤 팔굽혀펴기와 뜀걸음을 재차 지시했다.

이 과정에서 박모 훈련병이 쓰러졌다.

앞서 경찰은 지난달 군 수사대에 사망사건 발생 사실을 통보다고 사건을 이첩받은 뒤 본격 수사에 나섰다.
