서울중앙지법 민사합의14부(부장판사 정하정)는 14일 조 대표 부녀가 조선일보와 소속 기자 A 씨를 상대로 제기한 손해배상 소송에서 “피고들이 공동으로 조 대표에게 700만 원을,야구 던지는 법조 씨에게 1000만 원을 배상하라”라고 판결했다.재판부는 “조선일보의 규모 및 영향력,야구 던지는 법조 대표 부녀의 사회적 지위,야구 던지는 법조선일보의 사후 대처 등을 고려해 위자료를 산정했다”고 설명했다.

조선일보는 2021년 6월 21일 성매매 시도 남성을 상대로 절도 범행을 벌인 3인조 혼성 절도단에 관한 온라인 기사를 보도했다.이후 A 씨가 이 기사에 일러스트를 삽입했다.A 씨가 사용한 삽화는 같은 해 2월 27일 조선일보에 게재된 칼럼에 사용됐던 것이었다.가방을 메고 있는 조 대표의 뒷모습과 모자를 쓰고 전화통화를 하는 조 씨의 모습,야구 던지는 법드라마에 출연한 배우 이병헌,야구 던지는 법변요한 씨의 모습이 합성돼 있다.

조 대표 부녀는 “해당 삽화가 사용돼 조 대표는 성매매를 시도한 남성이고 조 씨는 그 남성을 유인하는 여성이라는 사실이 적시됐거나 이를 연상할 수 있어 명예권과 인격권이 침해됐다”며 손해배상을 청구했다.

법원은 해당 삽화에서 조 대표 부녀를 식별할 가능성을 인정하면서도 조 대표 부녀가 주장하는 사실이 기사 내용에 적시되었다고 보기는 어렵다고 판단했다.다만 법원은 조선일보가 절도 범행을 보도하며 조 대표 부녀가 묘사된 삽화를 허락 없이 사용한 것은 초상권을 침해한 것으로 위법하다고 봤다.
