국가대표 축구선수 황의조의 사생활이 담긴 영상물을 유포한 혐의 등으로 재판에 넘겨진 황의조의 형수가 항소심에서도 징역 3년형을 선고받았습니다.

서울고등법원 형사14-1부는 지난해 26일 성폭력처벌법상 카메라 등 이용 촬영·반포 등 혐의로 재판에 넘겨진 황의조의 형수 A씨에게 항소 기각 판결을 내렸습니다.

1심 재판부는 A씨에게 징역 3년과 40시간의 성폭력 치료 프로그램 이수와 3년간 아동·청소년·장애인 관련 기관 취업 제한을 선고받았습니다.

A씨는 지난해 6월,부산대 토토자신이 황의조의 전 연인이라고 주장하며 황의조와 피해 여성들의 모습이 담긴 사진,동영상을 인스타그램에 공유했고 황의조가 다수 여성과 관계를 맺으며 피해를 줬다고 주장했습니다.

또,황의조에게 "풀리면 재밌을 것이다",부산대 토토"기대하라"며 촬영물을 유포하겠다고 협박한 혐의도 받습니다.

A씨는 1심 재판 3회에 이르기까지 줄곧 범행을 부인하고 해킹 가능성을 주장하다 돌연 범행을 자백하는 내용의 자필 반성문을 제출했습니다.

재판부는 "황 씨의 성 관련 영상을 유포할 경우 무분별하게 유포될 것임을 쉽게 알 수 있음에도 유포할 것처럼 협박하고,끝내 영상을 게재해 국내외로 광범위하게 확산했다"며 "확정적·반복적으로 범행했다"고 꾸짖었습니다.

또 항소심에서 A씨가 여덟 차례 반성문을 제출한 데 대해 "반성문을 언론에 공개해 피해자에 대한 2차 가해가 이뤄진 점,부산대 토토반성문에는 피해가 일부 축소돼 있고 납득할 만한 설명이 없는 점 등을 고려하면 A씨가 범행을 진지하게 반성하고 있다고 보기 어렵다"고 판단했습니다.
