서울고법 형사14-1부(박혜선 오영상 임종효 부장판사)는 오늘(26일) 성폭력처벌법상 카메라 등 이용 촬영·반포 등 혐의로 구속기소된 황 씨의 형수 A 씨에게 징역 3년을 선고했습니다.

재판부는 "A 씨가 인스타그램에 영상을 게시할 당시 사람들이 보인 관심,do casinos give free drinks in vegas유포 범위와 회수 가능성 등을 볼 때 피해자가 끝을 알 수 없는 피해를 입었다고 볼 수 있다"고 지적했습니다.

그러면서 A 씨가 1심에서 돌연 반성문을 내고 범행을 인정한 것에 대해선 "돌연 자백했으나 이를 언론에 공개해 2차 가해가 이뤄졌으며 사건 내용도 일부 축소 기재하는 등 범행을 진지하게 반성했다고 보기 어렵다"고 꾸짖었습니다.

A 씨는 1심에서 피해자에게 2천만 원을 형사공탁했지만 재판부는 이를 유리한 정상으로 반영하진 않았습니다.

A 씨는 지난해 6월 자신이 황 씨의 전 연인이라고 주장하며 황 씨와 여성들의 성관계 영상 등을 인스타그램에 게시하고 이를 빌미로 협박한 혐의 등을 받고 있습니다.

1심에서 A 씨는 인터넷 공유기를 해킹당했다고 주장하며 혐의를 부인하다 지난 2월 자필 반성문을 재판부에 내며 범행을 자백한 바 있습니다.

피해자 대리를 맡은 이은희 변호사는 선고 후 기자회견에서 "피해자의 의사에 반하는 공탁이 어떤 것인지를 판결문에 언급해 주신 것으로 척박한 상황에서 다소 위로받았다"고 밝혔습니다.

그러면서 현재 별도로 진행 중인 황 씨의 불법 촬영과 2차 가해 사건의 신속 수사를 촉구했습니다.

이 변호사는 "황 씨를 추가 소환하는데 4개월이나 걸리는 이유를 알기 어렵다"며 "피해자가 이 사건에서 바라고 있는 건 황 씨가 다른 사건의 피의자와 동일하게 대우받는 것"이라고 밝혔습니다.

서울중앙지검 여성·아동범죄조사1부는 지난 20일 검찰 송치 약 4개월 만에 황 씨를 성폭력처벌법 위반 혐의 피의자 신분으로 불러 조사했습니다.
