식약처의 1개월 판매 중단 명령은 적법

'보톡스'라고 칭하는 보툴리눔 톡신 제품인 '메디톡신'을 두고 식품의약품안전처가 내린 품목허가 취소 결정에 대해 법원이 또다시 제동을 걸었습니다.

대전고법 제1행정부(이준명 부장판사)는 오늘(13일) 메디톡신 제조사인 메디톡스가 식약처 등을 대상으로 제기한 품목허가 취소,야구 수명단축제조·판매중지 명령 등 취소 청구 2심 재판에서 메디톡스의 청구를 일부 인용했습니다.

법원은 메디톡스가 주장한 메디톡신 품목허가 취소·제조 중단 명령의 취소 요청을 받아들였습니다.

다만 메디톡스가 제조하는 의약품 전 품목에 대해 식약처가 내린 1개월 판매 중지 명령은 적법하다고 판단했습니다.

이에 대해 메디톡스 관계자는 "인용된 판매업무정지 1개월 처분에 대해 집행정지를 즉각 신청하여,판매에 차질이 없도록 하겠다"고 말했습니다.이어 "대법원 상고를 통해 판매업무정지 1개월 처분의 위법성을 밝힐 수 있도록 최선을 다하겠다”고 강조했습니다.

메디톡스는 그동안 수출용 메디톡신을 판매 대행업체를 통해 중국 등에 수출해왔습니만,야구 수명단축 식약처는 메디톡스가 국내 대행업체에 먼저 판매한 것을 두고 약사법을 어겼다고 문제 삼았습니다.

보톡스 제품이 국가출하승인 대상 의약품이기 때문에 약사법에 따라 식약처의 사전 승인을 받아야 하지만,야구 수명단축메디톡스가 이런 절차를 거치지 않고 국내 업체에 판매한 것으로 보고 2020년 10월 19일 해당 제품의 회수와 폐기를 명령했습니다.

또 메디톡스의 보톡스 제품인 메디톡신(50·100·150·200단위)과 코어톡스(100단위)의 품목 허가를 취소하는 행정 처분에 착수하면서 잠정적 제조·판매 중지도 함께 명령한 바 있습니다.
