수사 결과만으로 사무장 병원에 급여 지급을 보류할 수 있게 한 현행법 조항이 헌법에 어긋난다는 헌법재판소 판단이 나왔습니다.

헌재는 오늘(27일) 재판관 전원일치 의견으로 의료급여법 11조의5 제1항 가운데 사무장 관련 조항에 대해 헌법불합치 결정을 내렸습니다.

헌재는 해당 조항이 '급여 지급 보류'에 대한 처분 요건을 완화하면서도,이를 취소할 수 있는 수단은 법에 전혀 갖춰지지 않았다고 지적했습니다.

이에 따라 헌재는 내년 6월 30일까지 법을 개정하라며 시한을 정했는데,이때까지 개정이 이뤄지지 않으면 심판 대상 조항은 효력을 잃습니다.

앞서 A 의료재단은 의사가 대표가 아닌 이른바 '사무장 병원'을 운영하다가 적발돼 검찰에 송치됐고,넷텔러 도박이에 따라 관할 지자체 시장은 의료급여비용 지급을 보류했습니다.
