28일 민주노총과 경찰 등에 따르면 퇴거 불응 혐의로 현행범 체포된 민주노총 조합원 23명은 전날 오후 8시께부터 차례로 풀려났다.

이들은 지난 26일 서울 중구 서울지방고용노동청 건물 안에서 최저임금 인상,2023 fifa 호주/뉴질랜드 여자 월드컵업종별 최저임금 차별 적용 폐지 등을 주장하며 기습 시위를 벌였다.이 과정에서 여러 차례 건물 밖으로 나가달라는 경찰 요청에 응하지 않은 혐의로 체포됐다.

이후 남대문·성북·동작·강북·도봉경찰서 등 각 경찰서에 연행돼 조사를 받았다.

민주노총은 조합원 연행 후 즉각 반발 성명을 내고 "최저임금 수준 논의는 시작도 못한 채 업종별 차별적용 논의만 지속되고 있어 노동부 장관에 면담을 요구한 것"이라며 "연행자를 즉각 석방하라"고 촉구한 바 있다.
