앞서 A씨는 지난 2021년 4월 제자 B군(당시 초등학교 2학년)이 만든 찰흙 작품을 보곤 "수업 주제와 맞지 않는다"며 교실 바닥에 던지고 발로 밟은 후 쓰레기통에 버렸다.

비슷한 시기 B군이 교실에서 공놀이 활동을 하던 중 공을 세게 던져 멀리 나가자 A씨는 친구들이 보는 앞에서 공으로 B군의 머리를 여러 차례 내리친 혐의도 받는다.
