[앵커]

지난해 7월 발생한 해병대원 순식 사건을 수사해 온 경찰이 약 1년 만에 최종 결과를 발표했습니다.

피의자 9명 가운데 임성근 전 해병대 1사단장 등 3명은 혐의를 인정하기 어렵다며 검찰에 불송치하기로 했습니다.

윤희정 기자가 보도합니다.

[리포트]

경북경찰청은 해병대원 순직 사건에서 임성근 전 사단장에 대해 과실치사와 직권남용 혐의 모두 묻기 어렵다고 결론내렸습니다.

복장을 똑바로 하라는 등의 지시가 위험성을 창출했다고 보기는 어렵다는 게 그 이유입니다.

경찰은 1년 가까이 진행된 수사 결과 발표를 통해 이같이 밝히고 임 전 사단장을 불송치 하기로 결정했습니다.

함께 입건된 하위 간부 2명에 대해서도 혐의가 인정되지 않는다며 불송치 결정을 내렸습니다.

경찰은 당시 사고의 직접적 원인이 11포병 대대장의 임의적인 수색지침 변경과 안전대책 미흡 때문이라고 지적했습니다.

이 과정에서 임 전 사단장이 11포병대대장과 직접 소통하거나 지시하는 관계는 아니었다고 경찰은 설명했습니다.

그러면서 11포병 대대장과 그의 직속상관인 7여단장 등 현장 지휘관 6명에 대해서만 업무상과실치사 혐의로 송치하기로 했습니다.

임 전 사단장에 대해 혐의를 묻지 않은 경찰 발표를 두고 박정훈 전 해병대 수사단장 측은 납득하기 어려운 결정이라고 반발했습니다.

반면,프랑스 오픈임 전 사단장은 그동안 제기된 허위 사실에 대해 민형사상 권리 구제를 하겠다고 밝혔습니다.
