부산지법 4-1형사부는 개인정보 보호법 위반 혐의로 기소된 공무원 A씨에 대한 항소심 선고 공판에서 검사의 항소를 기각하고 원심과 같은 무죄를 선고했다고 18일 밝혔다.

검찰의 공소사실을 보면 A씨는 2022년 4∼6월 부산의 한 행정복지센터에서 근무하던 중 사회보장 정보시스템에서 52차례에 걸쳐 남자친구와 가족의 개인정보를 무단 열람한 혐의다.

복지 수당을 받는 이들을 관리하는 사회보장 정보시스템에서는 생년월일,주소,전화번호,독감주사 맞고 몸살소득 등 인적 사항을 확인할 수 있다.해당 업무를 담당하는 공무원은 아이디와 비밀번호만으로 로그인하면 누구든 조회할 수 있다.

1심은 “피고인에게 잘못한 점이 없지 않지만,독감주사 맞고 몸살보안 절차를 무력화하지 않았다”며 “개인정보 보호법 위반 사실이 합리적 의심이 들지 않을 정도로 증명됐다고 보기 어렵다”고 무죄를 선고했다.

이에 검찰은 “남자친구가 자신에게 직업 등에 대해 거짓말을 하는지 확인하려는 이유로 개인정보를 무단열람한 피고인의 행위는 개인정보 보호법 입법 취지에 반하고 처벌 필요성이 있다”고 항소했다.

하지만 항소심 재판부는 “1심 판단은 정당하고,거기에 사실오인의 위법이 있다고 할 수 없다”며 검사 항소를 기각했다.
