고(故) 변희수 하사가 국립대전현충원에 안장된다.변 하사는 성전환 수술 후 강제전역 처분을 받자 2021년 3월 숨졌다.

국가보훈부 관계자는 지난 5일 "국방부 중앙전공사상심사위원회가 지난 3월 변 하사의 순직을 인정하면서 안장 자격이 생겼고,휘파람식당이후 신원조회 등을 거쳐 대전현충원 안장에 결격 사유가 없는 것으로 결론이 났다"고 밝혔다.

변 하사 유족에게 해당 결정이 통보됐고,휘파람식당유족과 대전현충원 측은 이장 날짜를 논의하고 있다.

앞서 변 하사 유족은 지난 4월 보훈부에 변 하사를 충북 청주 목련공원에서 국립대전현충원으로 이장해달라고 신청했다.

변 하사는 2019년 성전환 수술을 받았고 이듬해 육군은 수술 이후 생긴 신체 변화를 '심신장애'로 규정해 그를 강제 전역시켰다.

변 하사는 육군을 상대로 강제 전역의 취소를 구하는 행정소송을 제기했으나 첫 변론을 앞둔 2021년 3월 3일 집에서 숨진 채 발견됐다.

사망 7개월 뒤인 2021년 10월 대전지법 행정2부는 "심신장애 여부 판단으로 여성을 기준으로 해야 했다"며 원고 승소 판결을 했다.이 판결은 육군이 항소하지 않아 확정됐다.

2022년 12월 육군 보통전공사상심사위원회는 변 하사의 사망이 공무와 타당한 인과관계가 없다며 일반사망으로 분류했으나,휘파람식당국가인권위원회는 2023년 1월 국방부에 재심사를 권고했다.이에 국방부 중앙전공사상심사위원회는 올해 3월 변 하사의 순직을 인정했다.
