친족 사이 일어난 재산범죄는 처벌할 수 없도록 하는 우리 법의 '친족상도례'는 헌법에 어긋난다는 헌법재판소 결정이 나왔습니다.

헌법재판소는 오늘(27일) 오후 2시,프로야구 우천취소 규정형법 제328조 제1항에 제기된 헌법소원 사건에 대해 헌법불합치 결정을 내렸습니다.

헌재는 해당 조항이 친족 사이의 재산범죄에 대해 일률적으로 형을 면제해 범죄 피해자의 처벌 요구를 무시한다고 판단했습니다.

다만 즉시 위헌으로 판단할 경우 사회적 혼란이 일어날 것을 우려해 국회가 새로운 법을 입법하라고 주문하고,프로야구 우천취소 규정내년 말까지 법의 효력을 유지하기로 했습니다.

반면 헌재는 함께 살지 않는 친족 사이의 재산범죄는 고소가 있어야 재판에 넘길 수 있다는 친고죄 조항에 대해선 합헌 결정을 내렸습니다.

형법 제328조 제1항은 형제·자매나 배우자 등이 저지른 절도·사기·횡령 등의 재산범죄는 처벌할 수 없다는 이른바 '친족상도례'를 규정하고 있습니다.

친족상도례 규정은 친족 사이에 법이 지나치게 개입하는 것을 막기 위해 도입됐지만,프로야구 우천취소 규정최근에는 연예인 박수홍 씨,프로야구 우천취소 규정전 골프선수 박세리 씨 등이 가족 간 재산 분쟁에 휘말리는 만큼 시대착오적 법 조항이라는 지적도 일었습니다.
