약식명령에 불복해 정식재판을 청구한 A씨 측은 재판 과정에서 "몽유병이 있어 화장실을 가려고 했다"고 주장했다.

하지만 법원은 A씨가 몽유병으로 진료받은 사실이 없고,A씨 객실 안에 화장실이 있음에도 운동화를 신고 밖으로 나온 점,에볼루션 실시간출동한 경찰이 당시 A씨가 만취 상태가 아니었고 의사소통이 원활했다고 증언한 점을 토대로 혐의가 인정된다고 판단했다.
