(서울=연합뉴스) 황윤기 기자 = 부산시 산하 공공기관 임직원에게 사표를 종용한 이른바 '부산판 블랙리스트' 사건으로 재판에 넘겨진 오거돈 전 부산시장에게 징역형 집행유예가 확정됐다.

18일 법조계에 따르면 대법원 2부(주심 권영준 대법관)는 직권남용권리행사방해 혐의로 기소된 오 전 시장에게 징역 1년 6개월에 집행유예 2년을 선고한 원심판결을 지난달 30일 확정했다.

함께 기소된 박태수 전 정책특별보좌관은 징역 1년에 집행유예 2년,mgm 홀짝 분석기신진구 전 대외협력 보좌관은 징역 10개월에 집행유예 2년이 확정됐다.

대법원은 "원심 판단에 공모공동정범,mgm 홀짝 분석기직권남용권리행사방해죄 등에 관한 법리를 오해한 잘못이 없다"고 밝혔다.

이들은 오 전 시장 취임 이후인 2018년 8월부터 2019년 1월까지 임기가 남은 부산시 산하 공공기관 6곳의 임직원 9명에게 사직서 제출을 종용한 혐의 등으로 재판에 넘겨졌다.

오 전 시장 등은 법정에서 직권남용이 성립하지 않는다고 주장했다.

그러나 법원은 총 9명 중 6명에 대해 오 전 시장의 연루를 인정하고 유죄를 선고했다.

부산테크노파크 임직원 2명과 부산경제진흥원 1명에 대한 혐의는 '직권'이 없거나 혐의가 충분히 입증되지 않았다는 이유로 무죄로 판단했다.

1심 법원은 "법령과 절차를 준수하지 않은 권한 행사가 '정책적 판단' 내지 '정무적 성격'이라는 미명으로 용인될 수 없다"면서도 "사적인 목적을 위해 저지른 것으로 보이지는 않는다"며 징역형의 집행을 유예했다.2심의 판단도 마찬가지였다.

오 전 시장과 검찰이 각각 불복했으나 대법원은 2심 판결에 잘못이 없다고 보고 상고를 전부 기각했다.

오 전 시장은 여직원 2명을 강제 추행한 혐의로 별도 재판에 넘겨졌고 징역 3년이 확정돼 현재 수감 중이다.오는 26일 만기 출소한다.
