그러나 대법원은 "영장 없이 이뤄졌다고 해서 위법하다고 단정할 수 없다"며 2심 판결을 깼습니다.

대법원은 경찰관과 업소 운영자의 대화가 공개된 장소에서 이뤄졌고 대화 내용이 특별히 보호받아야 한다고 보기도 어렵다며 대화 녹음의 증거 능력을 인정했습니다.

그러면서 수사기관이 적법한 절차와 방법에 따라 범죄를 수사하면서,카지노 전설증거를 보전할 필요가 있고 일반적으로 허용되는 방법으로 범행 현장에서 관련자들과 수사기관 사이 대화를 몰래 녹음하는 건 위법하지 않다고 판단했습니다.

대법원은 경찰관이 단속사실을 알린 뒤 촬영한 사진에 대해서도 "경찰관은 피고인을 현행범으로 체포했고,체포 원인이 되는 성매매 알선 혐의사실과 관련해 촬영했다"며 형사소송법에서 영장 없이도 강제처분할 수 있는 경우에 해당한다고 봤습니다.
