담당 변호사가 재판에 빠져 패소 확정

[앵커]

학교폭력에 시달리다 숨진 고 박주원 양의 소송에 나가지 않아 재판에 지게 만든 권경애 변호사에게 법원이 5천만원을 배상하라고 판결했습니다.9년 동안 딸을 위해 싸워 온 어머니는 기가 막힌 판결이라며 대법원까지 가보겠다고 반발했습니다.

학교폭력에 시달리던 고 박주원 양은 지난 2015년 세상을 떠났습니다.

이를 인정하는 심리부검 결과도 있었지만 책임지는 사람은 없었습니다.

[이기철/고 박주원 양 어머니 (2023년 4월 6일) : 물리적인 폭력이 보이지 않아서 할 수 있는 게 없다고 말씀하시는 게 말이 되나…]

교육청과 학교,메이플월드 코디가해 학생과 부모에게 소송을 냈지만 모두 지고 판결이 확정됐습니다.

사건을 맡은 권경애 변호사가 재판에 가지도 않았기 때문입니다.

어머니는 권 변호사를 상대로 2억원을 물어내라는 소송을 냈고 법원은 5000만원을 배상하라고 판단했습니다.

"권 변호사가 재판에 나가지 않은 건 고의에 가까운 중과실"이라며 "오랜 기간 이어진 소송이 허망하게 끝나 고통이 컸을 것"이라고 밝혔습니다.

다만,메이플월드 코디권 변호사가 9천만원을 주겠다는 각서를 쓴 점,메이플월드 코디따돌림을 당했을 때와 숨졌을 때 사이의 시간 간격이 길어 이길 가능성이 낮았을 거라며 재산상 손해배상 1억원은 인정하지 않았습니다.

소송에 들어간 비용은 거의 다 어머니가 내라고 했습니다.

어머니는 대법원까지 가서라도 억울함을 풀겠다고 했습니다.

권 변호사가 받은 정직 1년 처분은 올해 8월로 끝나 이후엔 다시 변호사로 활동할 수 있습니다.
