15일 법조계에 따르면 대법원 1부(주심 서경환 대법관)는 이날 이 전 대표가 신청한 '토지관할의 병합심리' 신청을 기각했다.

이 전 대표는 지난 1일 대법원에 쌍방울 대북송금 사건 재판 진행을 서울중앙지법에서 진행 중인 다른 사건과 병합해달라며 '토지관할의 병합심리' 신청서를 냈다.

현재 서울중앙지법에서 공직선거법 위반,카지노 중독성위증 교사,카지노 중독성대장동·백현동·성남FC·위례신도시 사건 등 여러 재판이 진행되는 만큼 수원지법에 기소된 사건도 서울에서 진행되게 해달라는 취지다.

형사소송법에 따르면 토지관할이 다른 여러 개 관련 사건이 각각 다른 법원에 있으면 공통의 상급법원은 검사나 피고인의 신청에 따라 한 개 법원으로 병합 심리하게 할 수 있다.서울중앙지법과 수원지법의 상급 법원은 각각 서울고법과 수원고법이라 이들의 공통된 상급 법원인 대법원에서 병합 심리 여부를 결정한다.

수원지검과 서울중앙지검 수사팀은 병합 신청에 대해 지난 10일 대법원에 각각 반대 의견서를 냈다.검찰은 "특가법상 제3자 뇌물죄와 외국환거래법 위반 등 범죄사실이 서울중앙지법 관할과 관련이 전혀 없다"며 "경기지사 시절 있었던 사건이고 공동 피고인들이 수원지법에서 판결을 받았거나 심리가 진행 중이기 때문에 토지관할 병합 심리 신청을 기각해야 한다"는 취지의 의견을 낸 것으로 전해졌다.
