도박 집중단속 - 2024년 실시간 업데이트

대부업 불법행위를 특별점검한 금융감독당국이 50억원 규모의 허위 자본금으로 영업을 한 업체를 적발했습니다.

오늘(14일) 금융감독원은 5월 한달 간 대표이사와 대주주 등 특수관계인과 금전거래가 많은 9개 대부업자를 대상으로 특별점검을 진행한 결과,도박 집중단속한 대부업체의 가장납입 혐의를 적발해 수사의뢰했다고 밝혔습니다.

A 대부업체의 B 이사는 회사 설립 후 증자 과정에서 자본금을 가장납입한 혐의가 드러났습니다.

B 이사는 유한회사의 경우 주식회사와 달리 회사 설립과 자본금 변경 등기 시 주금납입보관증명서를 제출하지 않아도 되는 점을 악용해 이같은 일을 저질렀습니다.

구체적으로 2019년 설립된 A 대부업체의 경우 그해 3차례에 거쳐 20억원의 자본금 변경 사항과 관련해 허위로 등기를 먼저했고,도박 집중단속실제 자본금 납입은 시차를 두고 진행했습니다.

다음 해에는 추가로 두 차례에 걸쳐 30억원의 증자를 등기하기도 했는데,도박 집중단속이때는 허위로 등기만 하고 자본금은 납입하지 않았습니다.

이에 금감원은 납입가장행위가 확인된 B 이사에게는 사법당국에 수사를 의뢰했습니다.

상법상 납입가장행위에 대해선 5년 이하 징역 또는 1천500만원 이하의 벌금이 처해집니다.

또 자본금을 허위기재해 등록 신청한 A 대부업체에 대해선 법규와 절차에 따라 엄정조치할 계획입니다.

금감원은 "추후 대부업자 대상 워크숍을 통해 이번 불법행위를 업계에 전파하고 재발방지 등을 교육할 것"이라며 "앞으로도 현장검사 등을 통해 적발된 대부업자의 불법행위에 대해선 강력 대응하겠다"고 강조했습니다.
